Timeshare contracts are complex and often resolve from an opaque and complicated structure  involving resorts, marketeers, vendor and loan companies, some of which may even be located in off shore jurisdictions such as the Isle of Man or the British Virgin Island. Unravelling such matters requires a solicitor with specialist knowledge not only of the legal issues, but also of the structure, provenance and operational mechanics of each timeshare company. Buyers of timeshare should have had the opportunity to thoroughly review the contract and take an informed, unpressurised decision. Many have found themselves trapped in contracts they didn’t understand and no longer want and/or can no longer afford, whilst others have inherited these contracts and find themselves tied to a contract they never entered into and have no knowledge of. To further aggravate matters, often many of these timeshare contracts were backed by loans, brokered by agents of the timeshare resort, who, at one moment claim to be acting as an agent for the resort and at the next moment, are able to arrange loans with well known financiers such as Barclays Partner Finance, Shawbrook Bank, GE Money or Hitachi at the click of a finger. The client then not only has to contend with an unwanted timeshare contract, but also has to deal with an oppressive loan.

Most notably Pinder Reaux have assisted clients in achieving positive outcomes in the following specific scenarios:

  1. Bringing proceedings in the Queens Bench Division of the Royal Courts of Justice for a couple concerning a well-known timeshare resort based in Europe.


  1. Bringing proceedings against a well-known timeshare finance provider in which the sales practices and sales promises of the resort for whom they loaned significant monies to the customer were criticised. This resulted in a significant amount of the loan being disallowed by the Court.


  1. Assisting and advising in a group action concerning Azure Resorts, the Financial Conduct Authority and Barclays Partner Finance, as featured for example, in the Financial Times


  1. Assisting clients in enforcement of a foreign judgment against an international timeshare resort who also held assets offshore.
